Please note that all delivery charges are non refundable. Please note delivery dates and times are only given as a guidance and we hold no responsibility if for any reason, we cannot deliver as requested. The responsibility for off loading lies with the customer – we can supply vehicles with crane off loading facilities if requested and paid for. We allow 30 minutes for customers to off load our vehicles – if our vehicle is kept waiting longer than 30 minutes we will charge waiting time of £100.00 per hour. Please note we only charge in full hours. In the event of a failed delivery for reasons beyond our control First Fence LTD reserve the right to request cleared funds payment in full for any additional charges such as aborted delivery charge, waiting time charges, re-delivery charge prior to arranging re-delivery of the goods.

It is the customer’s responsibility to fully inform us of any delivery restrictions including restrictions on times and sizes of vehicles and if crane off loading facilities are required. It is imperative that the customer gives us the full information prior to us quoting any delivery charges. We can then ensure than the delivery charge is quoted correctly and accordingly to the requirements. If a delivery results in a failed delivery due to circumstances beyond our control, this will result in an aborted delivery charge which could be greater than the original delivery charge. If the goods require delivering again it will also incur another delivery charge which might be greater than the original delivery charge as a result of delivery restriction information being given, that was not provided prior to the original delivery. In addition to this, a re-stocking charge will be applied to any goods returned to our yard.

Please note that First Fence Ltd operate a standard 20% re-stocking charge on all items that are returned in their original packaging. Non stock items and bespoke items may be subject to a higher re-stocking charge and possibly a handling fee. Please note some non stock items cannot be cancelled once ordered and no refunds will be issued. Any special bespoke items may be cancelled prior to the products having actually commenced production, but cannot be cancelled after production has commenced. Please note cancellation charges on non-stock special items and bespoke items might be significantly higher than our normal charges and will depend on the work that has already commenced and if goods have been despatched.

Our total liability in contract, tort (including negligence or breach of statutory duty), misrepresentation, restitution or otherwise, arising in connection with the performance or contemplated performance of the contract shall be limited to the contract price. We shall not be liable to you for any pure economic loss, loss of profit, loss of business, depletion of goodwill or loss of anticipated savings, in each case whether direct, indirect or consequential, or any other indirect losses whatsoever and howsoever caused.

Please note that on all hire contracts we charge 1 month in advance and both delivery charge and collection charge is payable upfront on the first invoice prior to the hire contract commencing. Please note that on most hire contracts there is a minimum hire period charge - please ensure that you check this.

We do not offer fixed price quotations and all quotes are subject to fluctuation depending on manufacturer’s price increases and decreases. All products are offered subject to availability. All Goods and Services are sold subject to our Standard Terms and Conditions of Sale and our Standard Terms of Conditions of Hire. It is the Customers responsibility to check that all Goods supplied are correct – size, type, colour etc prior to making any modifications ie painting / powder coating etc or installing the Products. If there is a mistake with Size / Type / Colour First Fence Limited will exchange the Products within a reasonable time scale, however First Fence Limited will not accept any liability for any Incorrect Products that have actually been installed or modified ie painted / powder coated if we were not made aware beforehand.

First Fence Limited reserves the right to supply a similar product without notification from a different manufacturer should there be any availability issues with our normal supplier. This might be for various reasons including availability or manufacturing faults etc. Although we are constantly updating our website occasionally a product shown may be on back order or no longer available. If the unavailability of a product would be a problem for you we recommend you contact us prior to ordering to check on availability.
